Personal Injury Damages for Motorcycle Accident Victims

Motorcycle accident victims can collect three types of damages for their accident: economic, non-economic, and punitive. Unlike some states, Nevada does not cap or limit most types of damages a motor vehicle accident victim can collect. A victim’s damage award may be determined in settlement negotiations with a defendant or by a judge or jury at trial. In either case, a Spring Valley motorcycle accident lawyer may be able to help you receive a fair award.

Economic Damages

Economic damage awards compensate accident victims for their “economic” or monetary losses. Common financial losses resulting from these accidents include medical costs, travel costs to and from medical appointments (including transportation and lodging costs for out-of-town appointments), and lost wages from past and future missed work.

Non-Economic Damages

Non-economic damages compensate victims’ past and future pain, suffering, and mental anguish. This damage award will likely correlate to how severe a victim’s injury is, their predicted recovery or inability to completely recover, disfigurement, and the overall burden the accident has placed on the victim’s life.

Punitive Damages

While punitive damage awards are extremely rare, they are sometimes awarded in extremely audacious cases. These cases typically occur as a result of a defendant’s malicious behavior or astonishing gross negligence, per the Legal Information Institute (LII). Malicious behavior in a motorcycle accident case may include road rage and aggressive driving.

Extreme gross negligence could be drunk driving, especially in cases of defendants who have already been reprimanded for drunk driving or previously injured someone in a prior drunk driving case.

Damages Specific to Wrongful Death Lawsuits

A wrongful death lawsuit will also cover the expenses associated with burials, funerals, and other logistical aspects that resulted from your loved one’s loss. If you have unfairly lost a loved one, you deserve justice on their behalf. In order to pursue a wrongful death lawsuit, a few factors must be considered.

For instance, your relationship to the decedent and the cause of their death will influence your case’s proceedings.

Wrongful Death Motorcycle Accident Lawsuits

We do not only represent injured victims. We also represent their families. A wrongful death lawsuit is one that holds someone responsible for causing another person’s death, either as a result of negligence or wrongful behavior. Wrongful death lawsuits, like personal injury lawsuits, are civil lawsuits. That means that they have nothing to do with the criminal justice system.

Therefore, if the person responsible for your loved one’s death is also facing criminal charges for their actions, you can still file a wrongful death lawsuit against them to pursue justice for your family. The outcome of your lawsuit will not have any bearing on the criminal case. Your criminal law attorney and the justice system will handle that case 100% independent of your wrongful death lawsuit with us.

Why You Might File a Wrongful Death Lawsuit

Wrongful death lawsuits provide families peace and financial security as they grieve and plan to move forward with their lives. Losing a loved one is an emotionally devastating experience, often demanding time off of work to heal and deal with the logistical implications of a loved one’s death.

If you have lost a loved one who was a financial provider, a wrongful death lawsuit may ensure your family’s future financial security, compensating for the long-term loss of the decedent’s earnings.

The Statute of Limitations

The statute of limitations is a time limitation on how long you have to file your lawsuit from the time of your loved one’s death. In Nevada, the wrongful death statute of limitations is two years under NRC §11.190(4)(e). Unfortunately, a lawsuit cannot often be filed after this time, so it is important to make sure that if you plan to file, you do so within this time period.
